Unless I misread this Bill it basically says that "Unless it is a clerical error, it shall be unlawfull for any person to violate any provision within the Bill and therefor potentially liable for a cival penalty of not more than $15,000 for each violation".
I have during my 40 years of working within the motor industry seen many legislation changes launched by those politicians we actually vote into office. Like many of the thousands of Professional Businesspeople I know who are engaged in the business of Decontaminating Vehicles and Providing Quality Recyled Auto Parts I often wonder if some of our so called leaders or their advisors have ever lived in the same world as us mere mortals.
$15,000 Fines, Huge anomolies and holes in the basic concepts, One Billion US Dollars and 50 Million US Dollars for "administration".
When will politicians realise that the Professional Auto Recycling Industry is a Multi Million Dollar Industry with the potential to benefit the Environment.
Replacing a worn out Engine in a so called clunker with a lower mileage, Tested, Guaranteed Recycled Engine would not sell more New Cars but would save CO2 by the bucketload.

Quotes from the Consumer Assistance to Recycle and Save Act of 2009 and suggestions
(1) Requirement of Motor Traders / Dealers - Transfer each eligible trade-in vehicle surrendered to the dealer under the Program to an entity for disposal (Suggestion - Please Use The Directories Above to find your nearest Professional Auto Recycling Entity)
(2) Requirement of Motor Traders / Dealers - Disclose to the person trading in an eligible trade-in vehicle the best estimate of the scrappage value of such vehicle (Suggestion - Please Use The Directories Above to find your nearest Professional Auto Recycling Entity who can Give you a true Value)
(3) Requirement of The National Highway Traffic Safety Administration - establish requirements and procedures for the disposal of eligible trade-in vehicles and provide such information as may be necessary to entities engaged in such disposal to ensure that such vehicles are disposed of in accordance with such requirements and procedures, including requirements for the removal and appropriate disposition of refrigerants, antifreeze, lead products, mercury switches, and such other toxic or hazardous vehicle components prior to the crushing or shredding of an eligible trade-in vehicle, in accordance with rules established by the Secretary in consultation with the Administrator of the Environmental Protection Agency, and in accordance with other applicable Federal or State requirements
(Suggestion 1 - Please Use The Directories Above or provide links to the Directories as a basis of a simple and Cost effective method of Guiding all Dealers to Their Nearest Professional Auto Recycling Entities who already have the abbility to dispose of Vehicles in accordance with requirements for the removal and appropriate disposition of refrigerants, antifreeze, lead products, mercury switches, and such other toxic or hazardous vehicle components prior to the crushing or shredding of any Vehicle)
(Suggestion 2 - Please Use your influence with the various EPA and other Federal Authorities to provide data on the companies to whom they have granted licences in order that each Licenced Recycler may have an applicable logo attached to their company record) |

My personal observation is that In their rush to bring in bills which are designed in part to "Move New Vehicles and help manufacturers" as well as "Attempt to help the Environment" virtually every Government in the world who has created a "Clunker or Scrappage Scheme" has missed some very simple facts of what happens out there in the real world.
The most obvious fact is that vehicles up to 25 years old and liable to be used as an "eligible trade-in vehicle" are also liable to have had many parts replaced, not least of which is likley to be the "Engine"
In the UK there is a central vehicle registration Centre called the DVLA where every Vehicle in the UK has its Registration Plate Issued and by the rule of Law if a replacement Engine is Fitted then the DVLA is supposed to be informed. In the real world however the majority of Garages, Replacement Engine Fitting Centres or DIY Motorists ignore this requirement.
It follows therefore that a search on the VIN Number at the DVLA in the UK on a "Scrapped Vehicle" would result in a high chance of their being a mismatch on Vin and Engine Number Details.
In the USA each state has its own Vehicle Registration Centre and the combination of intertrading of vehicles state to state and a similar attitude to informing the relevant authoritie/s regarding Engine Number Changes a virtually nightmare of potential fines of $15000 could unfold especially on the Genuine Professional Auto Recycler.
This situation in the US especially could be caused by any circumstances by which the Engine of a Vehicle has been changed and that fact not known to the Vehicle Owner, missed by the Dealer only for the Genuine Recycler having removed it to discover it is in fact a replacement and mismatched to the VIN.
In fact the problem may even expand itself outside of the ring of Vehicle Owner, Dealer and Recycler involved in a single Cash for A Clunker Transaction. Imagine for example if the Engine has been replaced and the original engine has years ago entered or subsequently enters the "Core and Reconditioning Market", what then happens to the unfortunate Genuine Auto Recycler entwined in an investigation. |

Suggestion to Reduce potential Problems, save adminstration costs and paperwork which may destroy trees |

Below we have produced 3 very specific Example forms (Half Size) for use by each entity involved in a "Clunker Transaction"

Each form is slightly different but all have a common denominator being the VIN Number.
The forms are based on the Generic Find-A-Part Forms used extensively world wide for over 20 plus years and the Data is processed and stored on secure servers in two highly secure technology centers.
As with the Find A Part System Data Mineing / Reports etc can be carried out via secure https and Password Protected access.
The concept itself is simple, practical, extreely cost effective to any known alternatives and will be put into place in the near future.
By enabling or even requiring all 3 entities in any Clunker Transaction to complete a form a data and paper trail is established which should eliminate "Clerical Errors".
Most importantly it can be used by any of the 3 entities or indeed any one of them to show an independant source of information should they face investigation and a potential $15,000 fine through no fault of their own.

On completion of the form your Vehicle Data and Your Details are held on our secure servers in the UK.
Your Personal Information totaly safe because we are required in the UK to hold all personal Data and information as confidential under The Data Protection Act.
The Information regarding your Vehicle Details, as well as the Town and State will be the only details made available to The National Highway Traffic Safety Administration for their analysys at this stage as you may well decide not to actually purchase a new vehicle.
If you would also like to use your stored data to transmit the details of the vehicle you wish to Trade In to (A) participating Motor Dealers) or (B) to Licenced Vehicle Recyclers to obain an idea of its Recycling value, you can select to do so. This will require the transmiting of your e.mail address.
On Submitting the form you will receive an on screen confirmation with your unique Reference Number and a Confirmation E.Mail to keep for your records.
The objective of providing you with this form is to provide you, on your request, with documented and databased proof of the details of the vehicle as proof of the details of the Vehicle you entered into the Cash for Clunkers Scheme should there be an investigation and a potential $15,000 fine through no fault of your own.

On completion of the form your Vehicle Data and Your Details are held on our secure servers in the UK.
We suggest that you ensure that you get the Client with the (Eligible trade in Vehicle) to complete form 1 which can actually be done at your site if you can provide this facility.
As with all forms your Personal Information is totaly safe Under the UK Data Protection Act and The Vehicle Details will be held in our Database Cross referenced to The Data supplied on Form 1.
If you would also like to use your stored data to transmit the details of the vehicle you are required to dispose of to Licenced Vehicle Recyclers to provide the Customer with an estimate its (Recycling / Scrap Value), you can select to do so. This will require the transmiting of your e.mail address.
On Submitting the form you will receive an on screen confirmation with your unique Reference Number and a Confirmation E.Mail to keep for your records.
The objective of providing this form as with all the forms is to provide you, on your request, with documented and databased proof of the details of the Trade in Vehicle as proof of the details of the Vehicle you received for the Cash for Clunkers Scheme should there be an investigation and a potential $15,000 fine through no fault of your own.

We suggest that for your benefit you check to ensure that the Client and the Dealer have either Completed form 1 and Form 2 respectively or obtain copies of the relevant documentation.
As with all forms your Personal Information is totaly safe Under the UK Data Protection Act and The Vehicle Details will be held in our Database Cross referenced to The Data supplied on Form 1.
On Submitting the form you will receive an on screen confirmation with your unique Reference Number and a Confirmation E.Mail to keep for your records.
The objective of providing this form especially is that despite your company being the last handler of a "Cash For Clunker Vehicle" the requirements of proof of removal of contaminants and Engines and final Scrapping / Crushing etc etc of the Vehicle will be your responsibillity even given that you have received no financial rewards under the Cash for Clunkers Scheme.
There is no doubt in my mind that the starting point for the investigators of scheme will be the Auto Recycler who last handled the vehicle and by completing the form you will know that the details of the Vehicle you received will be available from an independant source, The Green Footprint Network, should there be an investigation and a potential $15,000 fine through no fault of your own.
